6. Academic Norms for Graduates of Shanghai Jiao Tong University

Chapter One General Rules

Article 1 These norms are formulated in accordance with regulations of our country and the practice of graduate education of Shanghai Jiao Tong University, for the purpose of enhancing academic disciplines and developing serious attitude towards study.

 

Article 2 These norms provide regulations of academic behaviors of graduates (including graduates with professional degrees), students with qualifications equivalent to graduates and doctors who apply for their appropriate degrees and those who have obtained master's degrees and doctoral degrees of Shanghai Jiao Tong University.

 

Article 3 Graduates shall actively participate in the relevant courses, lectures and activities on academic norms and grasp the norms of paper writing and improve the skills of paper writing. Graduates shall abide by the relevant rules and academic norms when they conduct academic activities. Relevant staff of the department and the supervisor shall offer education of academic norms, effective guidance and proper supervision when graduates conduct researches and write papers.

 

Article 4 The investigation of conducts against academic rules shall adhere to the fair and open principles, follow the procedures and deal with them in a proper way. Measures of combining education and punishment shall be taken and the resolution shall be announced properly.

Chapter Two Academic Ethics and Codes

Article 5 Rights and interests of others shall be respected. Quotation and citation shall be properly used in accordance with academic morals. Citation shall not be the main part of students' research paper.

 

Article 6 References shall be given when students cite views of points, schemes, materials and data from others. Citation shall be from original documents or primary sources in principle. If citation is from a secondary source, references shall be given.

 

Article 7 The signature of work units shall be Shanghai Jiao Tong University if the achievements are made when students study in Shanghai Jiao Tong University. The achievements including their important materials and technology can be used effectively and fully by Shanghai Jiao Tong University. The ownership of invention shall be Shanghai Jiao Tong University and the inventor share the earnings brought by patent rights.

 

Article 8 The signature of the research paper shall be true to facts. Only those who contribute to the research paper are qualified to sign their names. Those who are qualified shall sign their names except it is necessary to maintain secrecy or they give written approval. The name of contributors shall be signed in an order of their contribution except legal agreement.

 

Article 9 The research paper shall be reviewed and signed by those who put their signature to the paper before it is published. The authors shall be responsible for their own part and take legal responsibility. The main author shall be responsible for the whole achievement.

 

Article 10 The academic paper and other papers related to the academic dissertation that are going to be published in the name of Shanghai Jiao Tong University shall be reviewed and approved by the supervisor before mailing or submitting the application. Important information including the title of the paper, the author and the date of registration shall be informed to the supervisor and the agent appointed by the supervisor and recorded.

 

Article 11 Acknowledgments shall be given to persons or organizations that once offer guidance, advice and support when the paper is published. Once mistakes are found in the paper, relevant persons and organizations shall be informed timely and effective measures shall be taken to remedy the situation.

 

Article 12 Chinese, punctuation, numbers and foreign languages shall be used right in the paper.

Chapter Three Affirmation of Academic Dishonorable Behavior

Article 13 It is affirmed that students have academic dishonorable behavior once they have behavior as follows:

1. Achievements made by others are used as the main part of the paper.

2. Sources of the direct references of others' views of points, schemes, materials and data are not given or the rate of resemblance is high (including comparison with the translation version).

3. Forge or distort research achievements, research data and citation of others. Fabricate academic conclusions without sound arguments.

4. Provide fake academic experiences and research achievements. Forge materials of experts' opinions, certificates and other materials that can prove academic abilities.

5. Papers are written by others or write papers for others.

6. Publish research achievements repeatedly.

7. The collective research achievements are published in the name of oneself without the consent of the supervisor or the project leader. Important research achievements and findings are concealed or leaked deliberately.

8. Sign names in the achievements without participation or sign others' names without consent.

9. Use achievements belonging to Shanghai Jiao Tong University without permission or turn the ownership to others.

10. Technological and economic values and social influence of the research paper are exaggerated deliberately.

11. Achievements are obtained through improper means during the degree conferment.

12. Other behavior that is against the recognized academic morals in academic circles.

Chapter Four Punishment of Academic Dishonorable Behavior

Article 14 The academic degree evaluation committee of Shanghai Jiao Tong University is the organization of dealing with academic dishonorable behavior. The office of the academic degree evaluation committee of Shanghai Jiao Tong University is the organization of dealing with complaints about the aforementioned academic dishonorable behavior.

 

Article 15 The office of the academic degree evaluation committee of Shanghai Jiao Tong University will decide whether to investigate in accordance with the degree of the problem and materials about the complaints. Anonymous complaints are usually not dealt with.

 

Article 16 Before investigation, the department shall inform the person who is suspected of involving academic dishonorable behavior. If possible, informers shall be informed timely. The person who is suspected of involving academic dishonorable behavior can provide the investigation panel with written materials for defense or require the department and the investigation panel to hold a hearing to defend himself/ herself in public.

 

Article 17 The relevant department shall be informed by the office of the academic degree evaluation committee once the investigation is approved. Within five workdays, the department shall establish a panel that consists of at least three people (the number of people shall be odd. If necessary, experts from other universities can be employed to investigate) to conduct the investigation and affirmation. If necessary, the informers, respondents and witness shall be required to accept investigation.

The panel shall submit written investigation report, conclusion of affirmation and all related materials to the department within 30 workdays. Responses shall be included in the report and conclusion.

The department shall offer advice of punishment in accordance with the report and conclusion and submit the written report of punishment along with the investigation report, conclusion of affirmation and all related materials to the office of the academic degree evaluation committee of Shanghai Jiao Tong University.

 

Article 18 Those who have academic dishonorable behavior shall be punished as follows in accordance with the seriousness of the problem: degrees shall be postponed conferring; degrees shall not be conferred; degrees shall be revoked. The supervisor who has joint liability cannot recruit graduates within one to three years or be cancelled the qualifications to recruit graduates (all types of graduates). Students who still study in Shanghai Jiao Tong University can be punished by the relevant unit.

 

Article 19 The conclusion of punishment shall be announced properly and filed in the document of the one who is punished and send to the one who is punished. The handover of the conclusion shall be recorded.

 

Article 20 All the procedures and materials shall be kept secret before formal decision is announced. All people involved shall not leak the situation of investigation and punishment.

In the process of investigation, proper measures shall be taken to protect the legitimate interests of the informers, the witnesses, the investigators and the respondents.

 

Article 21 Those who object the decision can lodge an appeal to the office of the academic degree evaluation committee within 30 workdays since the decision of punishment is issued. Overdue appeal will not be accepted. The implementation of the punishment will proceed during the time of appeal.

The procedures are as follows:

1. The objector submits written appeal to the office of the academic degree evaluation committee.

2. The office of the academic degree evaluation committee organizes relevant department to review the decision. Within 15 days, a conclusion must be made. If the original decision of punishment is proper, it shall be maintained. If the original decision of punishment is inappropriate, it shall be dealt with in accordance with the procedures of punishment timely. If the complaints are untrue, it must be clarified. Relevant personnel who fabricate evidence and slander others will administer severe punishment.

3. Those who still have objections to the decision can submit written appeal to Shanghai administrative department for education, the office of the academic degree evaluation committee of Shanghai and the office of the academic degree evaluation committee of the State Council or institute court proceedings to People's Court.

These rules shall come into force upon promulgation. The Office of the Academic Degree Evaluation Committee is responsible for interpreting the rules.
